DMCA Policy (Copyright)

BanglarBhumi respects intellectual property rights and expects users of our site to do the same. If you believe that content on BanglarBhumi infringes your copyright, this page explains how to notify us and the procedures we follow in response to alleged infringement. This policy follows the general framework of the Digital Millennium Copyright Act (DMCA) and outlines steps for submitting a takedown notice and counter-notice.

What to include in a proper DMCA Policy takedown notice

To help us process your request quickly, please include the following information in your takedown notice. Incomplete notices may delay processing.

  1. Identification of the copyrighted work(s) you claim has been infringed. If possible, include URLs or a brief description.
  2. Identification of the material claimed to be infringing — provide the exact URL(s) on BanglarBhumi where the material appears.
  3. Your contact information — name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (typed name in an email is acceptable for electronic submissions).

Send the notice to copyright@banglaarbhumi.com. We will respond to acknowledge receipt and begin our review.

How we handle takedown notices

Upon receipt of a valid DMCA Policy notice, we will:

  • Review the claim promptly.
  • If the claim appears valid, remove or disable access to the allegedly infringing content.
  • Notify the poster (user/author) that we have removed or disabled access to the content and provide them with a copy of the takedown notice.
  • Inform the poster of their right to submit a counter-notice (see below).

Counter-notice procedure

If your content was removed and you believe the removal was a mistake or the material was misidentified, you may submit a counter-notice. A counter-notice must include:

  1. Identification of the removed material and location prior to removal.
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement consenting to jurisdiction of the federal district court for your address (or if you are outside the U.S., consenting to an appropriate jurisdiction).
  4. Your physical or electronic signature.

Send counter-notices to copyright@banglarrbhumi.com. We will forward the counter-notice to the original complainant and, unless the complainant files a court action within 10–14 business days, we may restore the removed material.

Repeat infringer policy

BanglarBhumi implements a policy for terminating accounts of users who are repeat infringers. If a user repeatedly posts infringing content after receiving notices, we may terminate access to our services and remove content.

Note about fair use & non-copyright issues

A takedown notice should only be used for copyright infringement issues. If you believe your content was removed in error under a valid fair use claim, you may use the counter-notice procedure — but consider consulting legal counsel before submitting a counter-notice. The DMCA Policy process is not for other claims like defamation, trademark, privacy policy, etc.; contact legal@banglaarbhumi.com for other legal matters.

Alternative dispute resolution

Some disputes are best resolved with direct communication between the rights owner and the content poster. If you are willing, consider contacting the site author (when available) before sending formal notices to seek a resolution.
